FLO RIDA'S A JERK, but Fat As Butter Festival is still on!

Flo Rida is a prime moron, and it would take a lot more than someone like him to stop an awesome little festival like Fat As Butter.

The rapper has dodged a hefty bullet this week - a $400,000 bullet. The 32-year-old "artist" (that's a loose term these days, isn't it?), failed and disappointed 11,000 people at 2011's Fat As Butter festival, when just minutes after he was due to go on, he told organisers that he would not be performing.

Organisers, Mothership Music, told the awaiting crowd: "Flo Rida has slept in and will not be able to make the concert."

Mothership Music then sued Flo Rida and his management, VIP Entertainment and Concepts, for breach of contract and damages.

However, they were unable to serve the rapper with a summons to appear in court.

Judge Judith Gibson then ordered that they could be served via email and a posting on his Facebook wall, on the basis that Flo Rida was apparently in NSW at the time, and under the District Court's jurisdiction.

After Flo Rida failed to appear in court, Judge Gibson ordered him to pay Mothership mMusic $380,000 in damages for lost revenue and reputation, plus at least $20,000 in legal costs.

The decision was then challenged by Flo Rida in the NSW Court of Appeal.

On Tuesday, the appeal was upheld, and it was found that Facebook and email were not appropriate for serving an international rapper with a summons to appear in court.

"Personal service on the defendant is the primary means of service under the Uniform Civil Procedure Rules," Justice Robert McFarlan said in his reasons for judgment.

"The evidence did not establish, other than by mere assertion, that the Facebook page was in fact that of Flo Rida and did not prove that a posting on it was likely to come to his attention in a timely fashion."

Sadly, Mothership Music has gone into voluntary liquidation as of yesterday. Organisers have issued a statement tonight that they guarantee and "100% confirm that it’s business as usual for Fat As Butter", and that the liquidation of Mothership Music will not interfere with the running of this year's festival.

Fat As Butter is a totally separate Proprietary Limited company and is in no way financially linked to Mothership Music or effected by the decision of the Flo Rida appeal.

The statement also read: “Despite all of this, Flo Rida is still a prime dickhead, and it would take a lot more than someone like him to stop this awesome festival.”

The Dwarf couldn't agree more.
